This communication shall not constitute an offer to sell or the solicitation of an offer to buy securities nor shall there be any sale of these securities in any state in which such solicitation or sale would be unlawful prior to registration or qualification of these securities under the laws of any such state. Offers are made only via our Private Placement Memorandum (PPM). To obtain further information, by request only, you must meet the suitability standards required by law.
There are a total of 75 shares of $10,000.00 each available to produce these character driven films. The shares will be divided according to each individual investment via a Private Placement Memorandum.
25 shares of $10,000.00 each are available for each of the topical documentaries listed on “Our Projects” page, with each film having its own Private Placement Memorandum.
The financial engine behind the film business continues to be the home entertainment segment which is composed of retail sell-through, video rental, video on demand (VOD) and digital. In the last ten (10) years, the home entertainment revenue window typically has been responsible for 80% of all of film profits – a highly fertile market for documentaries and message focused productions.
Investors will receive 100% of their investment plus a 20% flat return of interest of their principal from net profits in addition to receiving a 50/50 split of the net profits between investors and creators.
The 50/50 back-end split is a net profit share for each $10,000.00 invested.
Section 181 of the IRS tax code, has provided a 100% tax deduction for investments in film productions for more than a decade, and we expect this provision to be renewed again this year.
There are proven models for documentary distribution. These models include pre-sales, grassroots meetings, road shows, and conventions as well as traditional DVD retail, rental, television, digital and ancillary channels.
For theatrical release of our films, our Theater Captains are volunteers who have extensive grassroots political “Get Out The Vote” experience and utilize these proven techniques to turn out viewers, motivate the sales of DVDs and books, and provide on the ground deployment of our creative guerrilla-marketing arm of operations.
Hollywood marketing has continually looked to well defined audiences. In 2004, the $250,000,000.00 release of Michael Moore’s documentary“Fahrenheit 9/11” demonstrated a large market in the political interest niche, previously overlooked by mainstream Hollywood.
The release of “An Inconvenient Truth” and subsequent films such as “Sicko”, “Bowling for Columbine”, “Expelled”, “Capitalism: A Love Story”, “America”, “Inside Job”, and “2016: Obama’s America”, have demonstrated that films which have a connection to a political audience can gain significant sales traction.
The total aggregated gross of the top ten political documentaries of all time has been nearly half a billion dollars. These ten political documentaries combined have grossed nearly as much as Titanic, Harry Potter, or Iron Man, but our investment cost is only a small fraction per movie of those blockbusters!
Hence, from a production plus marketing investment of only a million dollars ($1,000,000.00) we have the potential to return more than TEN THOUSAND PERCENT! We can achieve our return in less than one year’s time.
100% TAX DEDUCTION
IRS Code Section 181 states that investment in a motion picture shot in the U.S. is 100% tax deductible for the investor in the same year invested. Under Section 181 an investor may deduct the money that is invested in a film or television production from his or her passive or active income earned in the same year. We expect this provision to be available for 2017 taxes. Please consult with your tax authority for all tax advice.
PROMOTION & ADVERTISING
The majority of a traditional film’s advertising budget is still spent on television advertising. Over the course of the last few years media spending has migrated from television to other media advertising but still remains prohibitively expensive.
Appellate Films’ model is able to brand our DVD releases alongside our theatrical releases and other DVDs, show our own products in theater trailers with our own movies (and of course with other movies), display our multiple products in trade shows and conventions (CPAC, etc), and thus bring awareness to a larger audience through repeated contacts and long term relationships.
Appellate Films, LLC is an American independent film production, marketing, and distribution company with a passion for innovation, a love of freedom, and an abiding commitment to integrity. Our films tell the truth, serving justly both our clients and our audiences.
Appellate Films is more than just a production company. We are idea-inspired and people-driven, determined to advance positive cultural, educational, and political renewal through every Appellate Films project.
As filmmakers we help activists, visionaries, authors, teachers, entrepreneurs, and business innovators engage the public through creative use of dramatic, visually and emotionally compelling media.
Funds invested – small and large – into this for-profit film about Joe Arpaio may be treated much like donations to a traditional non-profit organization, but unlike such charitable giving, our films have the potential of returning profits to all our investors.
What better way to “pay it forward” while expanding the reach of our message? Imagine the benefits of bringing this story to the nation and the world via mass communication in the most powerful medium of our time!
And funding isn’t all about big investors or big money either. Our client-partner model is collaborative; our per share investment is only $10,000.00. This makes project partnering an affordable, potentially tax deductible write off, not only for the wealthy but for middle income Americans and their friends and family, too.
